Celeb Deep respects the intellectual property rights of others and expects users of the Site to do the same.
This DMCA Policy explains how copyright owners or their authorized representatives may submit notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. ยง 512, and how users may submit counter-notifications where they believe material was removed or disabled by mistake or misidentification.
1. How to Submit a DMCA Notice
If you believe that material available on the Site infringes your copyright, you may submit a written DMCA notice through the copyright contact channel listed in Section 8.
To help us review the claim, the notice should include substantially the following information:
(a) your physical or electronic signature, or the signature of a person authorized to act on behalf of the copyright owner;
(b) identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list of those works;
(c) identification of the material claimed to be infringing and information reasonably sufficient to allow the Site to locate the material, such as the exact URL or URLs where the material appears;
(d) information reasonably sufficient to allow the Site to contact you, such as your name, mailing address, telephone number, and email address;
(e) a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright ownerโs agent, or the law; and
(f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
2. Review and Response
Upon receipt of a substantially complete DMCA notice, the Site may remove or disable access to the identified material and may notify the user who submitted or posted the material.
A notice that does not include enough information to identify the copyrighted work, locate the material, or contact the complaining party may not be sufficient for review. Where appropriate, the Site may request additional information.
The Siteโs removal, disabling, restoration, or continued hosting of material in response to a notice or counter-notification does not constitute a legal determination that the material is or is not infringing.
3. Counter-Notification
If you believe that material you submitted was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification through the copyright contact channel listed in Section 8.
A counter-notification should include substantially the following information:
(a) your physical or electronic signature;
(b) identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled;
(c) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
(d) your name, address, telephone number, and email address;
(e) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which the Site operator may be found; and
(f) a statement that you will accept service of process from the person who submitted the original DMCA notice or that personโs agent.
Upon receipt of a substantially complete counter-notification, the Site may forward it to the original complaining party. The removed material may be restored in accordance with 17 U.S.C. ยง 512(g), unless the complaining party notifies the Site that it has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material.
4. Repeat Infringer Policy
The Site may terminate or restrict access for users who are determined, in appropriate circumstances, to be repeat infringers.
The Site may consider factors such as the number, validity, frequency, and seriousness of copyright complaints associated with a user, account, email address, IP address, or other identifying information available to the Site.
5. Misrepresentations
Under 17 U.S.C. ยง 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneysโ fees.
Do not submit a DMCA notice or counter-notification unless you have a good-faith basis for doing so.
6. No Waiver of Rights
The Site reserves all rights, claims, defenses, and remedies available under applicable law.
Nothing in this Policy should be understood as an admission that any material is infringing, that any particular defense does or does not apply, or that the Site has waived any protection available under applicable law.
7. Changes to This Policy
The Site may update this DMCA Policy from time to time. Updated versions will be posted on this page with a revised โLast Reviewed and Updatedโ date.
